'Office' Spin-Off 'Not Necessarily A Thing Yet'

When Steve Carell's Michael Scott left "The Office" last spring, no one really knew who would helm the Scranton Branch of Dunder Mifflin. Eventually the company hired from within and that coveted managerial spot went to Andy Bernard, played by "The Hangover" star Ed Helms. Just as goofy and perhaps less bumbling than his predecessor, week after week Bernard has used his Cornell University education to try to be the glue that keeps the office together.

When MTV News caught up with writer and castmate B.J. Novak on the red carpet at the Screen Actors Guild Awards Sunday night, he teased that the show still has some legs and that, even eight seasons in, there's still some surprises up the sleeves of the writers on the long-running NBC comedy, even as they think about how the show might wrap up someday.

"We have some things in mind how Jim and Pam might end up, and how Dwight might end up, and how Andy and Erin might end up," he said. "And I've always had a vision for how Creed ends up, and it's not pretty. But we're still feeling it out. We're still kind of learning the dynamics in the post-Steve Carell era and hopefully we'll find a lot of new surprises."

There is, however, lots of talk that one of those folks will get their own spin-off in the coming years. Last week, sources said that a Dwight Schrute spin-off is in the works and that it would focus on Rainn Wilson's character and his life at Schrute Farms, incorporating other members of the eccentric Schrute family. But any plans for that show are mysterious to Novak. "It's just an idea and I'm not involved in it," he said. "And I'm interested to see how they develop it, but it's not necessarily a thing yet. It's just an idea."

Hillary Clinton goes to UN as Syria crisis deepens (The Envoy)

Secretary of State Hillary Clinton heads to the United Nations in New York Tuesday for three days of high-stakes diplomacy aimed at breaking a stalemate at the UN Security Council over a resolution demanding a halt to violence in Syria.

"The United States condemns in the strongest possible terms the escalation of the Syrian regime's violent and brutal attacks on its own people," Clinton said in a statement Monday, announcing her plans to attend the UN Syria debate.

"The Security Council must act and make clear to the Syrian regime that the world community views its actions as a threat to peace and security," Clinton said. " The violence must end, so that a new period of democratic transition can begin."

In the last ten months, over 5,000 people have been killed in Bashar al Assad regime's brutal crackdown against anti-government unrest. Syria's neighbors are increasingly alarmed that the mounting death toll could ignite sectarian violence throughout the region.

UN Security Council action condemning Assad's brutal crackdown has been blocked until now by Russia, which holds veto power in the world body.

Now, however, such a resolution has not just American, European and Turkish backing, but that of the Arab League as well. This past weekend, the Arab League suspended a monitoring mission to Syria.

In a sign of the urgency of the matter, British Foreign Secretary William Hague is also coming for the UN Security Council Syria debate.

Syrian human rights activists said they are placing increasingly desperate hopes on the UN.

"It has become the last chance for the Security Council to Act," Syrian pro-democracy activist Radwan Ziadeh told Yahoo News in a telephone interview from New York Monday.

Ziadeh is one of a group of Syrian opposition activists who had just come from a meeting Monday with Russia's ambassador to the UN, Vitaly Churkin. So far, Ziadeh said, the Russian envoy gave no sign Moscow would budge on its opposition to a resolution condemning Assad. Syria is Russia's closest ally in the Middle East. "But we hope in last minute negotiations Russia agrees to not use its veto, to at least not block a resolution," Ziadeh said.

US Ambassador to the UN Susan Rice said Monday that the United States and allies would back a resolution drafted by Morocco on behalf of the Arab League. She said that since the the draft does not call for Libya-style military intervention or even new sanctions, the resolution should not raise objections or require extended debate. Still, she did not rule out the idea that Russia would block the measure.

Russia's continued objection to Security Council condemnation of Assad has both political and economic components.

"Basically there are domestic constraints that [Russian Prime Minister Vladimir] Putin is under because has his own election process and ? his giving in to pressure abroad and dumping Assad would not look good for him domestically given he has faced protests at home," Andrew Tabler, a Syria analyst at the Washington Institute for Near East Policy, told Yahoo News Monday. "It seems that our arm-twisting with the Russians hasn't borne fruit yet."

"The question is what kind of resolution is possible," Tabler added. "There are a 100 different ways this could go."

Body of girl, 6, who fell into Ore. river is found

ESTACADA, Ore. -- The body of a 6-year-old girl swept into the Clackamas River last week was recovered Saturday, deputies said.

Vinesa Snegur, of Portland, fell into the river about 30 miles east of Estacada on Sunday, Jan. 22. A volunteer located her body Saturday afternoon about four miles downstream, on the rocks of a shallow island.


The Clackamas County Sheriff's Office responded to the scene and recovered her remains soon afterward.

"It is believed Vinesa?s body had been previously trapped underwater, further upstream, and was recently dislodged by the high water levels," said Sgt. James Rhodes of the Clackamas County Sheriff's Office.

Background: School in mourning over girl swept into river

"She had been playing in the snow with her family when she fell into the frigid water and was swept downstream," Rhodes said last Sunday.

Crews searched for her from that night until the effort was suspended Tuesday. Water conditions had become too dangerous to send searchers into the river, Rhodes said.

Clackamas County Search and Rescue teams had planned to resume the search Sunday morning.

93% Mission: Impossible Ghost Protocol

Superbly directed action from the first minute to the last! Even if I still hold the original as my favourite in the series, the sensational stunts of this film is definitely one for the record books. The jaw-dropping sequence at the Burj Khalifa hotel - a rush of adrenaline that exhilarates to the extreme - comes especially to mind. Cast-wise, it's quite the pleasure as well. British funnyman Simon Pegg provides some nice comic relief (although corny such at times), while Paula Patton and Jeremy Renner bring out their absolute A-game. And for me as a Swede, it was an incredible, if somewhat surreal joy to see Michael Nyqvist as the villain. Just a few years ago, I would have never guessed him to take the leap over to Hollywood, but I'm sure glad that he did. Especially as he's one of the finest actors that our country has to present. As for the film's front figure, I can say only this: no longer may I have any respect for Tom Cruise the person (he's still a Scientologist after all), but he certainly hasn't faded one bit as a dare-devil action star. So what it boils down to here is one of the true must-see popcorn movies of 2011. Kudos to director Brad Bird, for making the impossible possible, and granting us an invite to a sequel that breathes new life into the franchise. He really pulled out all the stops on this one, delivering a fun and energizing, balls-to-the-wall action-fest. If it doesn't raise your pulse, you are either dead or made of stone. Because as far as spy thrillers go, this is one of the coolest ever conceived.

Arab League suspends Syria mission as violence rages (Reuters)

CAIRO/BEIRUT (Reuters) ? The Arab League suspended its monitoring mission in Syria on Saturday because of worsening violence, a move Damascus said was an attempt to draw foreign intervention as it struggles to quell a 10-month revolt against President Bashar al-Assad's rule.

The Arab League took the decision days after calling, unsuccessfully, for Assad to step down and make way for a government of national unity. It will take an Arab peace plan to the U.N. Security Council next week.

The rising violence in Syria took a dramatic turn this week when rebels seized three Damascus suburbs. On Saturday the army launched an offensive against them, leading to intense fighting.

"Given the critical deterioration of the situation in Syria and the continued use of violence ... it has been decided to immediately stop the work of the Arab League's mission to Syria pending presention of the issue to the league's council," Secretary-General Nabil Elaraby said in a statement.

Arab League foreign ministers are expected to discuss early next month the possibility of withdrawing monitors completely, a League official said, but added that the secretary general could pull monitors out at any time if necessary.

"Syria regrets and is surprised at the Arab decision to stop the work of its monitoring mission," state channel Syria TV cited a government official as saying.

"This will have a negative impact and put pressure on (Security Council) deliberations with the aim of calling for foreign intervention and encouraging armed groups to increase violence," the official added.

The Arab League mission was sent to observe Syria's implementation of a League peace plan, but the level of violence remained high and there was no sign of a let-up in the crackdown on unrest by Assad's forces.

The mission's mandate was extended for a second month, but critics said the team's presence had not lessened the fighting, and the mission was further undermined when Gulf states withdrew their monitors last week, saying the team could not stop the violence.

Diplomatic pressure on Assad to step down or to carry out the peace plan has been weakened by his continuing support from Russia and regional power Iran. Assad himself blames the unrest on foreign-backed militants.

FIGHTING, DEFECTIONS NEAR CAPITAL

There was fighting outside three rebel-held suburbs of Damascus on Saturday, activists said, adding they believed the army was trying to prevent the insurgents from building a stronghold in an area so close to the centre of government.

Eight residents were killed and dozens wounded and 11 government troops killed in the clashes, the Syrian Observatory for Human Rights said, adding that security forces shot dead four civilians and an army deserter elsewhere in the country.

The Damascus insurgents were emboldened by a string of reports of army desertions, and activists said one group of deserters had brought with them their three tanks.

A spokesman for the rebel forces, known as the Free Syrian Army (FSA), said he did not have a complete tally but estimated that over 100 soldiers had deserted in the area on Saturday.

Elsewhere, activists said they were still recovering bodies from a sectarian "massacre" of Sunni Muslims in a neighbourhood of the flashpoint city Homs, which they blamed on pro-Assad militiamen belonging to the president's minority Alawite sect.

The Syrian Observatory, which said the death count had risen to 47, said snipers and checkpoints had made it difficult for activists to enter the district and find all the bodies.

Activists told Reuters by telephone that rebels who control the towns of Saqba, Kafr Batna and Jisreen were exchanging fire with soldiers who were shooting back from tanks and had used anti-aircraft guns and mortars.

A video uploaded by activists, purported to be from a rebel-held Damascus suburb, showed smoke rising from behind a mosque and heavy gunfire erupting in the background as residents shouted "Allahu Akbar (God is greatest)."

It was not possible to verify the video or many of the details from activists, as media access to such locations is restricted in Syria.

The rebel FSA agreed a truce last week for government forces to withdraw from rebel-held Zabadani, 30 minutes' drive from Damascus. It said the army had had to pull back because of the large number of desertions from its ranks.

What began last March as peaceful protests against four decades of Assad family rule has grown more violent as protesters began fighting back against the security forces' crackdown and were joined by rising numbers of army deserters.

The United Nations said in December that more than 5,000 people had been killed in the wave of protests. Syria says more than 2,000 security force members have been killed by militants.

The state news agency SANA said "terrorist groups" killed seven soldiers, including an officer, in the Damascus suburbs on Saturday. SANA reported the burial of 28 members of the security forces killed in different parts of the country, and showed pictures of bloodied corpses and a funeral procession led by soldiers carrying wreaths.

U.N. RESOLUTION TALKS

On Friday, the Security Council discussed a European-Arab draft U.N. Security Council resolution aimed at halting the bloodshed in Syria. Britain and France said they hoped to put the draft resolution to a vote next week.

The Arab League's deputy secretary general said the group was also in talks with Russia ahead of the Security Council meeting.

Russian officials have not commented on their talks with the Arab League, but Moscow's U.N. ambassador Vitaly Churkin previously said Russia found the League plan unacceptable but was willing to "engage."

Russia joined China in vetoing a previous Western draft resolution in October and has since promoted its own draft. Churkin said Moscow wanted a Syrian-led political process, not "an Arab League-imposed outcome of a political process that has not yet taken place" or Libyan-style "regime change.

The prominent opposition Syrian National Council said it was joining the Arab League at its Security Council meeting to request "protection." The SNC has previously called for international forces to implement a no-fly zone in Syria.

Sunspot unleashes powerful parting shot

NASA's Solar Dynamics Observatory captures a picture of sunspot 1402 unleashing an X2-class solar flare on Friday, seen in ultraviolet wavelengths.

The sunspot responsible for setting off a colorful round of northern lights over the past week got off a doozy of a parting shot today, just as it was about to pass around the edge of the sun's disk.

Sunspot 1402 let loose with an X-class flare, the most powerful class of solar outburst, at 1:37 p.m. ET today, and NASA's Solar Dynamics Observatory captured a sequence of ultraviolet images as the blast went out. Fortunately, this one was not directed right at Earth.


SpaceWeather.com says NASA's Goddard Space Weather Laboratory detected a "spectacular" coronal mass ejection blasting away from the sun at 5.6 million mph (2,500 kilometers per second). CMEs send out electrically charged particles that can eventually interact with Earth's magnetic field ? but here again, this particular ejection is not heading directly for Earth. There's a chance that it might strike a glancing blow on Saturday or Sunday, sparking another bout of auroral displays.

The National Oceanic and Atmospheric Administration's Space Weather Prediction Center reports that the flare created R3-level radio blackouts at about 1:30 p.m. ET today. That level can result in wide-area loss of high-frequency radio comunication, as well as a temporary degradation of low-frequency GPS signals, but no significant problems came to light immediately. Solar radiation levels are elevated ? which may lead to the rerouting of some airline flights. NOAA's guide to space weather scales explains what's what.

Active regions move across the sun's disk from left to right, as seen from earth, so sunspot 1402 is just about to go around to the far side of the sun. There's a chance that the sunspot will come around again as the sun goes through its 27-day rotational cycle, and there are certain to be more (and stronger?) outbursts as the sun approaches the peak of its 11-year activity cycle in 2013 or so.

Keep a watch on SpaceWeather.com, NOAA's space weather website and the prediction center's Facebook page for updates during the weekend. And if you're living the high-latitude life, keep a watch for better-than-usual auroras as well.

Update for 4:05 p.m. ET: Sunday's solar storm not only blasted past Earth; it also sent solar particles streaming by NASA's Mars Science Laboratory, which is on its way to the Red Planet. Today, the Southwest Research Institute reported that one of the instruments on the spacecraft, the Radiation Assessment Detector, measured the effects of the solar storm.

"We only have a few hours of data downloaded from the RAD so far, but we clearly see the event," RAD principal investigator Don Hassler, science program director in SwRI's Space Studies Department, said in a news release. "It will be very interesting to compare the RAD data, collected from inside the capsule, with the data from other spacecraft."

Once Mars Science Laboratory gets to its destination, it will measure radiation levels on the Martian surface to determine what the effect might have been on past life ... as well as the radiation effects that astronauts can expect to experience during future interplanetary missions.

I read the article, and he's basically got problems with the search feature, the size of PDFs (or the quality of their previews?), and what happens to agency documents when an agency closes (they go to an agency that handles 'legacy' documents)

This is a very accusatory article and summary for the problems he's got. Non-transparency? Obfuscation? Or a work-in-progress? If new work is hidden away, or old work isn't made available in a straightforward and reasonable fashion, then complain... but this guy just comes off as complaining.

German priest jailed for 6 years for child abuse (AP)

BERLIN ? A German court has convicted a Roman Catholic priest of some 250 counts of sexually abusing children over a several-year period and sentenced him to six years in prison.

German news agency dapd reported that the state court in Braunschweig on Thursday convicted the priest, who was found guilty of abusing three boys aged 9 to 15 between 2004 and 2011.

The 46-year-old priest, who wasn't identified, was arrested in July after one victim told his mother what had happened. He admitted the abuse when he went on trial Jan. 13.

He also faces church disciplinary proceedings.

Germany, Pope Benedict XVI's homeland, was shaken in 2010 by revelations of abuse by clergy going back decades.

LA mayor signs law requiring condoms in porn films (AP)

LOS ANGELES ? Actors in adult movies filmed in Los Angeles will be required to use condoms under an ordinance signed into law by Mayor Antonio Villaraigosa, and porn industry leaders say the regulation could lead them to abandon the nation's porn capital.

The law, signed Monday, will take effect 41 days after it is posted by the city clerk, something that could happen as early as this week.

Officials with the AIDS Healthcare Foundation, which lobbied for years for such a law, expressed jubilation Tuesday and said they would now turn their attention to getting a similar condom requirement adopted elsewhere.

"The city of Los Angeles has done the right thing. They've done the right thing for the performers," said Michael Weinstein, president of the AIDS Healthcare Foundation, which had pushed the measure for six years.

He said its adoption is crucial in protecting adult film actors from HIV and other sexually transmitted diseases.

Weinstein said his group's next move will be to get Los Angeles County to adopt a similar measure for its unincorporated areas.

The group is in the midst of a petition drive to put the issue on the ballot, but Weinstein said he hopes the county's Board of Supervisors will react as the Los Angeles City Council did and pass such an ordinance itself. The council gave its final approval last week.

Industry officials estimate as many as 90 percent of the porn films produced in the United States are made in Los Angeles. Most are filmed quietly in the city's suburban San Fernando Valley.

After the council's action, several of the industry's biggest filmmakers said they might consider moving just outside the county. That prompted Simi Valley Mayor Bob Huber to announce last week that he would ask the city attorney for his community, located just across the county line from the San Fernando Valley, to write a similar ordinance.

Weinstein said Tuesday his group would also be vigilant in keeping track of where porn producers might go.

Exactly how the law will be enforced is still to be determined.

It calls for makers of porn films to pay a fee, the amount still to be determined, that would be used to pay for spot checks at filming locations.

The City Council is creating a committee to determine the amount of the fee and who would make the spot checks.

Weinstein said he envisions enforcement would fall on nurses or other public health providers.

"It is not anticipated, based on what we desire or what has been discussed, that it would be uniformed police officers," he said.

Weinstein said he would be open to working with industry leaders to enforce the law.

He noted the ordinance does not require condoms when oral sex is involved because his group, which originally crafted it, agreed with the filmmakers that infection through oral sex was not as great as through other sex acts.

The industry already requires that actors be tested for HIV every 30 days, and filmmakers say they believe that is sufficient.

"It's not that I don't doubt the sincerity of their desire to protect the talent. And believe it or not, we have the same ambition," Christian Mann, general manager of Evil Angel Productions, said last week after the council's vote.

"We just don't believe their way is the best way," added Mann, who is also on the board of directors of the industry trade group the Free Speech Coalition.

A win under belt, Gingrich lands in firing line (AP)

TAMPA, Fla. ? Fresh off his big South Carolina win, Republican Newt Gingrich found himself on the defensive Monday as the volatile GOP presidential contest shifted to Florida.

Chief rival Mitt Romney sharpened his attacks on the former House speaker, calling him "erratic" and pressing for disclosure of clients, contracts, records and other work he was paid to do after leaving Congress. Atop Romney's list are Gingrich's consulting arrangements with mortgage giant Freddie Mac and details of ethics investigations in the 1990s.

Romney also charged that Gingrich had engaged in "potentially wrongful activity" when he worked with former colleagues in Congress to create a prescription drug benefit for Medicare.

"We could see an October surprise a day from Newt Gingrich," Romney said after a round-table session with people struggling with home foreclosure problems.

Gingrich, who earlier had appeared on ABC's "Good Morning America," mocked Romney as "somebody who has released none of his business records, who has decided to make a stand on transparency without being transparent." After initially balking, Romney is set to release personal tax records on Tuesday.

The sniping between the two contenders opened a Florida fight that is shaping up as pivotal to determining which one of them will become the GOP's presidential nominee. The four candidates ? Gingrich, Romney, Rick Santorum and Ron Paul ? were to meet Monday night in Tampa for the first of two debates heading into Florida's primary on Jan. 31.

Gingrich, who planned a pre-debate campaign appearance on Monday afternoon in Tampa, basked in his come-from-behind triumph in South Carolina two days earlier. The win made for three different winners in the first three states to hold contests, with Santorum winning Iowa and Romney taking New Hampshire.

Gingrich's campaign said it had raked in $1 million in the first 24 hours since South Carolina's primary Saturday.

Frequently the aggressor in the race, Gingrich is now the one taking fire from all sides.

Santorum described Gingrich as too "high risk" to be the Republican standard-bearer. Romney has been calling Gingrich a lobbyist. Gingrich flatly denied lobbying on behalf of Freddie Mac or other clients.

"It's not true. He knows it's not true. He's deliberately saying things he knows are false," Gingrich said. "I just think that's what the next week will be like."

Gingrich told ABC he has campaign lawyers working to make the Freddie Mac records public. He said the decision rests with the Center for Health Transformation, which he founded but no longer owns. Two former Gingrich companies earned $1.6 million over eight years from Freddie Mac. Gingrich has said he only earned about $35,000 a year himself.

Gingrich's work for Freddie Mac has come under scrutiny because of its role in the housing meltdown.

After the housing forum Monday, Romney told reporters that Gingrich should consider giving back any money he earned from the troubled mortgage company.

Gingrich said he was braced for more criticism from his remaining opponents and their allies. On Sunday, some Republican leaders voiced worry about Gingrich's combative style.

He also seemed to be enjoying the attention.

"I think you're going to see the establishment go crazy in the next week or two," Gingrich said.

Japan manufacturers brace for euro zone breakup: Reuters poll (Reuters)

TOKYO (Reuters) ? Japanese manufacturers are bracing for a possible breakup of the euro zone, according to a Reuters poll released on Monday, with 65 percent saying they see a need to prepare for the currency block's partial or complete collapse.

Europe's two-year old sovereign debt crisis, which has left Greece teetering on the edge of default, has taken a heavy toll on Japanese corporate sentiment as exporters struggle with a strong yen and slower growth in China.

When manufacturers were asked if they are considering changing business plans in Europe, 31 percent of those responding said they are in the process of doing so or have already made changes. Of those firms, 90 percent said they could scale back operations or have already done so.

Many manufacturers were also looking to shrink operations in China and North America in favor of expanding in other Asian countries to tap demand for their goods, the survey showed.

Euro zone finance ministers will decide on Monday what terms of a Greek debt restructuring they are ready to accept as part of a second bailout package for Athens after negotiators for private creditors said they could not improve their offer.

Resolving the issue of a Greek debt swap is key to putting Athens' debt on a sustainable path and avoiding a chaotic default that could threaten the whole currency bloc.

The poll, taken January 5-17, surveyed 400 big firms, of which 247 responded. The questions were part of the Reuters tankan for January, which was published on Friday.

The tankan, which is closely correlated with the Bank of Japan's quarterly tankan survey of business sentiment, showed manufacturers remained pessimistic about business conditions for the second straight month in January.

Manufacturers showed concern about China's growth prospects, with 50 percent saying they could change their business strategy as China's red-hot growth cools. Of those firms, 65 percent say they could shrink operations.

China's economy is expanding at its weakest pace in 2-1/2 years, with sequentially softer annual growth in the last four quarters seen spilling over into the first three months of 2012, leading many analysts to expect the worst full-year growth in a decade.

The poll suggested half of Japanese manufacturers are taking another look at Asian markets excluding China, and 52 percent of those firm want to expand in an attempt to reduce dependence on the Chinese market.

Only 24 percent of manufacturers were considering changing their North American strategy, but 61 percent of those firms said they are likely to scale back.

Manufacturers were pessimistic on the Japanese market. One in three are reconsidering domestic business plans. Of those, 78 percent said they are likely to shrink operations.

Non-manufacturers, which include construction firms and retailers, were more positive on the domestic economy as they are likely to benefit from reconstruction following last year's record earthquake and the worst nuclear crisis in 25 years.

The survey showed that 75 percent of non-manufacturers are looking to change their domestic strategy, with 60 percent of those firms leaning toward expansion.

When manufacturers and non-manufacturers are combined, almost 70 percent say the global economy is the biggest risk to their outlook, followed by 57 percent who said they are worried about the rising yen.

Ambush on police truck in Syria kills 14 (AP)

BEIRUT ? At least 14 people were killed when multiple explosive devices struck a police truck transporting prisoners in a tense area of northwestern Syria on Saturday, the state-run news agency and an opposition group said.

The state news agency SANA blamed the attack on "terrorists" and said it occurred on the Idlib-Ariha highway, an area near the Turkish border that has witnessed intense fighting with army defectors recently.

Four bombs that went off in "two phases" hit the truck, and then attackers targeted an ambulance that arrived to assist the wounded, SANA reported.

Six policemen who were accompanying the prisoners were also wounded, some of them in critical condition, it said.

The British-based opposition activist group, the Syrian Observatory for Human Rights, confirmed the incident Saturday and put the toll at 11 dead prisoners.

Rami Abdul-Rahman, director of the group, said the truck was hit by several roadside bombs, but it was not clear who was behind the attack.

There was no immediate claim of responsibility, but members of the so-called Free Syrian Army are known to be active in the area.

A Syria-based activist said the area has several army encampments and is full of roadside bombs planted to target army tanks passing by, adding that the truck carrying prisoners may not have been the intended target.

The activist spoke on condition of anonymity for fear of reprisals.

The 10-month uprising against Syrian President Bashar Assad has turned increasingly militarized and chaotic as more frustrated regime opponents and army defectors arm themselves and fight back against government forces.

The capital has seen three suicide bombings since late December which the government blamed on terrorist extremists.

LOS ANGELES (Reuters) ? Three-time Grammy winner Singer Etta James, a pioneer of 1950s rhythm-and-blues and rock music known for her show-stopping hit "At Last," died on Friday at the age of 73.

Following are some keys facts about James.

* James died on Friday, January 20., due to complications from leukemia, according to her longtime manager and friend Lupe De Leon. Her live-in doctor said in December she was terminally ill. She had been in failing health for a number of years and also suffered from diabetes, kidney problems and dementia.

* Her hit songs included "The Wallflower," which originally was titled "Roll With Me Henry," "At Last," "All I Could Do Was Cry," "Something's Got a Hold on Me," "Tell Mama," "I'd Rather Go Blind" and "Stop the Wedding."

* James was born Jamesetta Hawkins in Los Angeles January 25, 1938, to a 14-year-old girl in Los Angeles. Over the years, her mother mentioned several different men as her father, including Rudolph Wanderone, the legendary pool hustler best known as Minnesota Fats. James came to think of Wanderone as her father and sought him out at a Nashville, Tennessee, hotel in 1987. She was unable to confirm he was her father but told an interviewer, "When he passed, he sent me a beautiful golden watch that hung on his clothes that had his name on it. And he sent me a letter and told me that he wanted me to write a song about him and stuff."

* James was an influence on performers such as Tina Turner, Bonnie Raitt, Diana Ross and Janis Joplin. She also toured as an opening act with the Rolling Stones and performed with the Grateful Dead.

* James fought a long battle with heroin addiction. In her autobiography, "Rage to Survive," she wrote that at one point she and an accomplice stole the musical instruments of her own band and pawned them in order to buy drugs. After stints in rehabilitation programs, she broke the habit at age 50.

* James' weight reached an estimated 400 pounds at one point and she often had to perform sitting down. She lost some 200 pounds after gastric bypass surgery about 10 years ago.

* James was survived by her husband, Artis Mills, two sons Donto and Sametto and four grandchildren.

Time To Bet On The Gaming ETF? - Zacks.com

Although the economic outlook remains uncertain, the gambling industry has come roaring back in months past. This is largely due to more hope over the health of the U.S. economy and continued growth in disposable income in many key emerging markets around the globe. Beyond these factors, some of the key gambling cities in the world have seen continued growth as well, suggesting that the worst may be over for the industry.

In fact, despite the broad concerns over the health of the Chinese market, Macao, the only city in the country where gambling is legal, has seen gambling revenues continue to surge to end 2011. Revenues rose 42% to a record of $33.48 billion ensuring that the city continues to be a Mecca for the global gaming industry. Additionally, the upstart of Singapore is expected to see double digit revenue growth as well, further cementing its spot as the second biggest gaming market on Earth despite only having two casinos which have been in operation for less than two years. Yet even for those looking closer to home, in the traditional hotspot of Nevada, news has been pretty good as well. Gambling revenue increased by 7% in November, suggesting that the growth isn?t limited to Asia alone (read Three Outperforming Active ETFs).

Even if the economy doesn?t pick up, however, casinos could see growth from the opening up of a variety of new markets which could provide casinos with fresh consumers for their resorts. State and national governments are becoming increasingly desperate for new revenues to plug budget holes and allowing the construction of casinos is a pretty easy way to boost collections. Often times, governments don?t have to spend anything they merely have to sanction the casinos, and given the broad aversion to spending cuts or tax increases this could be the way to go in the future (read Does Your Portfolio Need A Hedge Fund ETF?).

Already plans are in the works for multibillion dollar casino complexes in states such as Florida and New York, while smaller projects could be given the green light in states such as Ohio, Massachusetts, and a variety of others as well. The plans stretch beyond the U.S. too, as there are reports of new casinos in a number of Asian markets including South Korea, Japan, and a few smaller, less developed nations as well, suggesting that the coming years could see high rates of expansion for the gaming industry, even if just a fraction of these proposals go through the legislative process.

Gaming?ETF In Focus

Given these trends, some investors may want to consider making a bet on the continued resurgence of the sector in 2012 and beyond. For these investors, there is one ETF available that is a good proxy for the global industry; the Market Vectors Gaming ETF (BJK). This fund looks to track the S-Network Global Gaming Index, which is a ruled-based, modified cap-weighted, float-adjusted benchmark designed to give broad access to the global gambling industry. Currently, the fund charges investors 65 basis points a year in fees and holds 53 securities in total (read Top Three Consumer Staples ETFs).

In terms of country exposure, American firms dominate making up nearly 36.4% of total assets, by far the most for a single nation. Beyond the U.S., however, two Asian markets take the next spots with China (18.3%) and Malaysia (9.8%) rounding out the top three. Overall the exposure is pretty well spread out among countries and regions as Australia, the UK, Japan, and South Korea round out the top seven destinations. For individual securities, the most assets go towards Las Vegas Sands (LVS) with 15.3% of the total while Wynn Resorts (WYNN) and Genting comprise the rest of the top three, making up 7% and 6.4% of total assets, respectively.?

While the winds may be ad the industry?s back, investors should note that the sector is by no means without risks. Many casinos continue to struggle under heavy debt loads thanks to a pre-recession building boom and some have not yet recovered. Additionally, BJK has a beta of 1.3 suggesting that the fund can be far more volatile than the overall market. In fact, the fund?s best three month period saw a 50% gain while the worst three month period experienced losses of nearly 45%, showing just how quickly stocks in this sector can move (see ETFs vs. ETNs: What?s The Difference?).

Nevertheless, for investors who are encouraged by the plethora of casinos that could be opening up soon as well as strong revenue numbers from some of the top gaming destinations of the world, this could be an intriguing time to buy. The P/E of the fund is just 12.5 while the Price to Sales is 1.8, suggesting there could be some decent values in many of the securities in the fund. Add in a solid yield of over 2% and some risk-tolerant investors could hit the jackpot with this Van Eck ETF (read A Primer On ETF Investing).?

These fish find you can't beat a well-fed mate

For some animals, looks and wealth aren't everything. Female mosquitofish prefer mates that had a steady nutritional upbringing over those that suffered a poor start in life with a restricted diet, even though the male fish are physically similar in adulthood, a new study shows.

Male mosquitofish ? an invasive species in Australia originally introduced to control mosquitoes ? born in a food-scarce environment will delay sexual maturation and undergo a period of accelerated growth when food becomes available. The fish use this strategy, called compensatory growth, to ensure that they mature to the same size as males that developed normally. Researchers found that females choose to associate with larger males, regardless of developmental history, as is the case with many other animal species. But when given the choice between two equal-size males, the females gravitate toward the males that had experienced normal growth.

The researchers are unsure how the females are able to tell the difference between the seemingly identical males, but they suggest that differences in locomotion or the relative length of genital organs (called gonopodia) may be involved.

Whatever the case, "this work demonstrates there are hidden costs to a poor start in life," study lead author Andrew Kahn, a biology graduate student at the Australian National University, said in a statement.

A selection bias
Kahn and his colleagues reared 365 newborn male mosquitofish, all of which were fed the same amount of food for their first week of life. They then put about half of the fish on a severely restricted diet for three weeks, before returning them to a normal diet until they matured.

In an aquarium with three compartments, the researchers tested 47 pairs of full-sibling brothers that were nearly identical in size but had different developmental histories. They placed one male at each end of the aquarium and a virgin female in a transparent cylinder in a central compartment.

When the researchers removed the cylinder, the now-free females were more attracted to the normal-growth males ? they spent more time staring at those males.

The effects of poor nutrition
As for how the females could pinpoint a male fish's nutritional background, various physical or other cues may be at play. Perhaps the female fish caught a glimpse of the male's genitals. Research has shown that early food limitation decreases the length of a male's gonopodia relative to his body size and other studies suggest that females prefer males with longer gonopodia.

On the other hand, the females may have been able to detect subtle differences in how the males moved, a factor also affected by developmental history in some fish species.

At the end of the day, the researchers believe the females are looking to mate with the normal males because they are likely healthier.

"If males have undergone a period of poor nutrition they might be more susceptible to diseases, which they could then pass on to the female," Kahn said. "And there are the indirect genetic reasons ? by choosing males who have had a better development history, your offspring have a good chance of being better at getting food when they are young."

The research was published Jan. 11 in the journal Biology Letters.

A new research project into the role of sport in rehabilitating young prisoners has found that sport can be effective in reducing the reconviction rate of offenders.

The research project was led by Dr Rosie Meek, a lecturer in psychology in the Third Sector Research Centre at the University of Southampton, as part of her evaluation of the Portland Prison Sports Academy, an initiative developed by Bristol-based organisation, the 2nd Chance Project.

For the past two years, Dr Meek has been working with 81 young male adult offenders at Portland young offender institution in Dorset, who took part in football and rugby academies. The research has involved monitoring inmates' improvements during and after participation in the scheme, and tracking their progress after release. The academies were run intensively over 15 weeks, drawing on creative partnerships between prison staff, community delivery partners and the expertise of the 2nd Chance Project staff, who provided specialist support for offenders in the transition from custody to community.

Of the 50 participants who have been released over the past 18 months, nine have reoffended or been recalled to prison, representing an 18 per cent reconviction rate (compared to a prison average of 48 per cent after one year). Statistically significant improvements were also observed in established measures of conflict resolution, aggression, impulsivity, and attitudes towards offending following participation.

The aim of the project - to harness the power of sport in reducing reoffending - is especially pertinent in the context of current concerns about national reoffending figures. Indeed, it was the resettlement focus of the project that first inspired Dr Meek to get involved. She says: "I have devoted much of my research to exploring the psychological and social processes involved in the transition from prison to the community. Young offenders have one of the highest rates of reconviction after release, with around three quarters reoffending within a year.

"The current 'revolving door' effect ruins lives, damages communities and costs the UK economy billions. A clear finding from the research is that this innovative project is especially effective in using sport as a vehicle for change, engaging prisoners and motivating them to take responsibility for desisting from crime."

The research has found that, as well as improving behaviour and engagement among those serving longer sentences, the project provides crucial 'through the gate' support in the form of Justin Coleman, Transitions Director of the 2nd Chance Project. Justin's knowledgeable and supportive approach has had a long-lasting positive impact on those he works with, responding to the need for flexible and specialist resettlement provision which will address the complex needs of young people in prison.

The research findings will be launched on Friday 20 January at Twickenham stadium. The event will bring together almost 100 delegates made up of academics, prison staff, sporting representatives, and voluntary and community sector organisations.

For the past two years, Dr Meek has been working with 81 young male adult offenders at Portland young offender institution in Dorset, who took part in football and rugby academies. The research has involved monitoring inmates' improvements during and after participation in the scheme, and tracking their progress after release. The academies were run intensively over 15 weeks, drawing on creative partnerships between prison staff, community delivery partners and the expertise of the 2nd Chance Project staff, who provided specialist support for offenders in the transition from custody to community.

Of the 50 participants who have been released over the past 18 months, nine have reoffended or been recalled to prison, representing an 18 per cent reconviction rate (compared to a prison average of 48 per cent after one year). Statistically significant improvements were also observed in established measures of conflict resolution, aggression, impulsivity, and attitudes towards offending following participation.

The aim of the project - to harness the power of sport in reducing reoffending - is especially pertinent in the context of current concerns about national reoffending figures. Indeed, it was the resettlement focus of the project that first inspired Dr Meek to get involved. She says: "I have devoted much of my research to exploring the psychological and social processes involved in the transition from prison to the community. Young offenders have one of the highest rates of reconviction after release, with around three quarters reoffending within a year.

"The current 'revolving door' effect ruins lives, damages communities and costs the UK economy billions. A clear finding from the research is that this innovative project is especially effective in using sport as a vehicle for change, engaging prisoners and motivating them to take responsibility for desisting from crime."

The research has found that, as well as improving behaviour and engagement among those serving longer sentences, the project provides crucial 'through the gate' support in the form of Justin Coleman, Transitions Director of the 2nd Chance Project. Justin's knowledgeable and supportive approach has had a long-lasting positive impact on those he works with, responding to the need for flexible and specialist resettlement provision which will address the complex needs of young people in prison.

The research findings will be launched on Friday 20 January at Twickenham stadium. The event will bring together almost 100 delegates made up of academics, prison staff, sporting representatives, and voluntary and community sector organisations.

Romney goes after Santorum on felons voting

(AP) ? Seeking to protect his standing here, Republican presidential front-runner Mitt Romney on Tuesday assailed challenger Rick Santorum's record on voting rights for felons, an issue that resonates strongly with conservatives. Santorum accused the former Massachusetts governor of promoting lies about him as the two intensified their dispute from the previous night's GOP debate.

Romney tried to tamp down another contentious, lingering issue by offering a snippet of his personal tax picture while saying he wouldn't publicly release his tax return until April. The multimillionaire former businessman said he pays an income tax rate close to 15 percent ? well below the 35 percent applied to the nation's top earners ? because his income mostly comes from investments.

Romney, hoping a strong and third straight win in Saturday's South Carolina primary will all but lock up the nomination, made a point Tuesday of answering criticism from Santorum, the former Pennsylvania senator trying to unite conservative voters to block Romney's path.

"We have a candidate who's not going to stand up and tell the truth," Santorum told reporters in Charleston, complaining that Romney refuses to condemn misleading TV ads. "That leads to real serious questions about whether that man can be trusted to tell the truth on a variety of things."

Speaking separately in Florence, Romney defended the accuracy of the ads in question, although he maintains he has no control over the negative commercials that are flooding South Carolina media by outside groups that support his candidacy.

"I hear that Rick Santorum is very animated that the super PAC ad says that he is very in favor of felons voting," Romney said. "Well, he is! That's his position."

Romney's other three challengers tried a host of different attacks in hopes of knocking him off stride in the debate. They kept the spotlight on his wealth and business dealings by pressing him to release his income tax returns before this weekend's vote.

Romney told reporters Tuesday that he would release his 2011 tax return in April.

"What's the effective rate I've been paying? It's probably closer to the 15 percent rate than anything," Romney said, referring to the tax rate on investment income. The average American household will pay 9.3 percent in federal income taxes, although that rate climbs to 19.7 percent when other federal payroll taxes, for Social Security and Medicare, are included. Investment income isn't subject to those taxes.

Former House Speaker Newt Gingrich suggested Romney wouldn't delay releasing his tax information if he had nothing to hide and that the delay wouldn't sit well with voters in this month's primaries. "What is he saying to the people of South Carolina?" Gingrich said Tuesday. "You're not important enough for me to release my taxes? Nor are the people of Florida?"

Romney also came under heavy pressure in the debate on the issue of his job-creation record at his former private equity firm Bain Capital, and his evolving views on abortion. Blamed for the tide of negative commercials, Romney stressed the independence of the super PACs that have been running ads in his behalf against Santorum and Gingrich.

On Tuesday, Santorum said that by refusing to condemn the ads, Romney "supports lies, promotes lies and stands behind those lies."

Santorum was upset about an ad that says he "even voted to let convicted felons vote." Santorum complained that the TV spot, while referring to "felons," shows someone in an orange prison jumpsuit, suggesting Santorum would allow them to vote while still incarcerated. Santorum has supported voting rights only for those who have served their sentences and been released.

But Romney noted that "people who have been released from prison are still called felons if they've committed felonies."

Meanwhile, Gingrich picked up the support of South Carolina Lt. Gov. Ken Ard, who appeared with him in Florence, calling the former U.S. House speaker the smartest and toughest candidate. Romney already has the more coveted endorsement of Gov. Nikki Haley, a tea party favorite, however.

Monday's night's debate was as fiery as any of the more than dozen that preceded it. Romney, the man to beat after back-to-back wins in the Iowa caucuses and the New Hampshire primary, took heat not only from Gingrich and Santorum, but also from Rick Perry and Ron Paul.

The five will debate again Thursday night in Charleston, the last time they will share a stage before the primary two days later.

The first Southern primary could prove decisive in the volatile contest. Gingrich has virtually conceded that a victory for Romney in South Carolina would assure his nomination as Democratic President Barack Obama's Republican rival in the fall, and none of the other remaining contenders has challenged that conclusion.

It was Perry who challenged Romney to release his income tax returns. The Texas governor said he has already done so, and Gingrich has said he will do likewise later in the week.

"Mitt, we need for you to release your income tax so the people of this country can see how you made your money. ... We cannot fire our nominee in September. We need to know now," Perry said.
